Why do Real Estate Agents need General Liability

Posted on: January 21, 2026 by Karen Vuletich

Most Real Estate agents don’t carry their own General Liability policy. Why, because they think this coverage will be extended to them from the Broker firm GL policy. Most firms will have a GL policy, but Independent Contractors are not covered under the Broker’s GL policy. General Liability coverers mainly Bodily Injury and Property Damage while conducting Real Estate operations. The Broker’s E&O policy, depending on the carrier will cover the agents for Bodily Injury and Property Damage under Lock Box and Open House, but outside of that no coverage is afforded to the agent (Independent Contractor) of that Brokerage.

We recommend that each Real Estate agent, or Real Estate team carry their own General Liability policy to cover Bodily Injury/Property Damage while conducting real estate activates. This coverage follows you wherever you go. The cost is very inexpensive and can save thousands of dollars if an agent is personally named in a suit for Bodily Injury/Property Damage that they would then have to obtain their own Attorney to represent them in the suit.
